Definitions<\/h2>\n<dl>\n \t<dt>&#8220;Employee&#8221;<\/dt>\n \t<dd>Any person providing services to the Service d&#8217;aide aux conjoints \u2013 SAC for remuneration, including interns.<\/dd>\n \t<dt>&#8220;Board Member&#8221;<\/dt>\n \t<dd>Any individual who sits on the Board of Directors of the Service d&#8217;aide aux conjoints \u2013 SAC.<\/dd>\n \t<dt>&#8220;Participant&#8221;<\/dt>\n \t<dd>Any individual, whether or not a member of the organization, who provides confidential information to the Service d&#8217;aide aux conjoints \u2013 SAC in connection with receiving a service, participating in an activity or meeting, or contributing to a publication.<\/dd>\n \t<dt>&#8220;Event&#8221;<\/dt>\n \t<dd>Any event, activity, or meeting organized or managed by the Service d&#8217;aide aux conjoints \u2013 SAC.<\/dd>\n \t<dt>&#8220;Reporting Form&#8221;<\/dt>\n \t<dd>The form made available to any Employee or Participant to notify the person responsible for personal information.<\/dd>\n \t<dt>&#8220;Privacy Incident&#8221;<\/dt>\n \t<dd>Any unauthorized access to, use of, or disclosure of personal information, as well as its loss or any other form of breach of its protection.\n<\/dd>\n \t<dt>&#8220;Publication&#8221;<\/dt>\n \t<dd>Any publication produced by or contributed to by the Service d&#8217;aide aux conjoints \u2013 SAC, in any format (verbal, written, audio, video, digital, or other).<\/dd>\n \t<dt>&#8220;Privacy Incident Registry&#8221;<\/dt>\n \t<dd>The record of all reported incidents, including the circumstances of the incident, the number of individuals affected, the assessment of the severity of the risk of harm, and the measures taken in response. Relevant dates are also recorded: when the incident occurred, when it was detected by the organization, when notices were sent (if applicable), etc.<\/dd>\n \t<dt>&#8220;Serious Risk of Harm&#8221;<\/dt>\n \t<dd>The risk assessed following a privacy incident that could cause harm to the individuals concerned. This risk is analyzed by the person responsible for personal information, who evaluates the sensitivity of the information involved, the anticipated consequences of its use, and the likelihood that it will be used for harmful purposes.<\/dd>\n \t<dt>&#8220;Confidential Information&#8221;<\/dt>\n \t<dd>Any information provided to or collected by the Service d&#8217;aide aux conjoints \u2013 SAC, in any format (verbal, written, audio, video, digital, or other), that pertains to a participant or employee and can be used to identify them, including: their name, phone number, address, email, their status as a current or potential participant, their gender, their sexual orientation, and any information relating to their health.<\/dd>\n \t<dt>&#8220;Service&#8221;<\/dt>\n \t<dd>TAny service rendered by the Service d&#8217;aide aux conjoints \u2013 SAC to an individual at their request, or any activity in which they participate.<\/dd>\n<\/dl>\n<h2 id=\"section_2\">2. Photographs and Recordings<\/h2>\n<p class=\"p1\">Every individual has the right to choose whether or not to be photographed or recorded (audio\/video).<\/p>\n\n<h2 id=\"section_3\">3. Confidentiality Obligations<\/h2>\n<p class=\"p1\">Employees and Board Members are required to sign this confidentiality agreement before beginning their duties or mandates with the Service d&#8217;aide aux conjoints \u2013 SAC.<\/p>\n<p class=\"p1\">The confidentiality obligation applies for the duration of an employee&#8217;s or board member&#8217;s relationship with the Service d&#8217;aide aux conjoints \u2013 SAC and survives the end of that relationship.<\/p>\n\n<h2 id=\"section_4\">4. Collection and Use of Confidential Information<\/h2>\n<p class=\"p1\"><strong>4.1<\/strong> The Service d&#8217;aide aux conjoints \u2013 SAC may, as needed, create one or more files containing confidential information about employees and board members, for the purposes of keeping contact information up to date, documenting work or volunteer situations, and, in the case of paid employees, carrying out administrative tasks required or permitted by law (income tax, group insurance, etc.).<\/p>\n<p class=\"p1\"><strong>4.2<\/strong> The Service d&#8217;aide aux conjoints \u2013 SAC may, as needed, create one or more files containing confidential information about participants, for the purpose of organizing an event or publication, or providing a service.<\/p>\n<p class=\"p1\"><strong>4.3<\/strong> LThe Service d&#8217;aide aux conjoints \u2013 SAC may only collect confidential information that is necessary for the purposes of the file, and may only use that information for those purposes. Confidential information may only be collected from the individual concerned, unless that individual consents to collection from another source, or the law permits it.<\/p>\n\n<h2 id=\"section_1\">5. Management of Confidential Information<\/h2>\n<p class=\"p1\"><strong>5.1<\/strong> The Executive Director is responsible for ensuring the protection of personal information and may delegate this responsibility in writing. The name and contact information of the person responsible for privacy protection must be listed on the organization&#8217;s website. The Executive Director is also responsible for maintaining the Privacy Incident Registry.<\/p>\n<p class=\"p1\"><strong>5.2<\/strong> The Executive Director is authorized to access all confidential information held by the organization. Other employees may access confidential information only to the extent required to carry out their duties.<\/p>\n<p class=\"p1\"><strong>5.3<\/strong> For the purposes of applicable legislation, a privacy incident includes any unauthorized access to, use of, or disclosure of personal information, as well as its loss or any other breach of its protection.<\/p>\n<p class=\"p1\"><strong>5.4<\/strong> When an Employee, Board Member, or Participant becomes aware of a privacy incident, they must promptly notify the person responsible for privacy protection so it can be recorded in the Registry, by completing and submitting a reporting form.<\/p>\n<p class=\"p1\">The Registry must retain information about a privacy incident for five years. The reporting form must include: a description of the personal information affected (or the reasons why such a description cannot be provided); a brief description of the circumstances; the date or approximate period of the incident; the date or approximate period when the organization became aware of it; and the number of individuals affected (or an approximation).<\/p>\n<p class=\"p1\"><strong>5.5<\/strong> The responsible person determines whether the incident presents a &#8220;serious risk of harm.&#8221; The information and measures taken to reduce that risk are recorded in the Registry. If a serious risk of harm is identified, the responsible person notifies the Commission d&#8217;acc\u00e8s \u00e0 l&#8217;information and the individuals concerned using the appropriate form.<\/p>\n\n<h2 id=\"section_6\">6. Retention of Confidential Information<\/h2>\n<p class=\"p1\"><strong>6.1<\/strong> Employees with access to files are required to ensure confidential information is protected from physical damage or unauthorized access; that all electronic documents containing confidential information, including those copied to portable storage devices, are encrypted and password-protected (passwords must be changed twice a year and whenever access personnel change); and that paper files are stored in lockable cabinets that are secured at the end of each working day, with keys kept in secure locations.<\/p>\n<p class=\"p1\"><strong>6.2<\/strong> Files created under this policy are the property of the Service d&#8217;aide aux conjoints \u2013 SAC.<\/p>\n\n<h2 id=\"section_7\">7. Destruction of Confidential Information<\/h2>\n<p class=\"p1\"><strong>7.1<\/strong> The Service d&#8217;aide aux conjoints \u2013 SAC is committed to respecting individuals&#8217; right to be forgotten. Upon request, any person may have all their personal information permanently deleted from the organization&#8217;s digital and physical systems.<\/p>\n<p class=\"p1\">The organization commits to identifying expiry dates for personal information that is no longer needed; ensuring that closed files are shredded by a staff member or specialized service provider at the end of the retention period; and destroying all other confidential documents in the same manner.<\/p>\n<p class=\"p1\"><strong>7.2<\/strong> Subject to section 7.3, confidential information is retained only for as long as necessary to fulfill the purpose for which it was collected, unless the individual has consented otherwise. It is then destroyed in a manner that makes it irrecoverable.<\/p>\n<p class=\"p1\"><strong>7.3<\/strong> Employee files are retained by the Service d&#8217;aide aux conjoints \u2013 SAC.<\/p>\n\n<h2 id=\"section_8\">8. Disclosure of Confidential Information to Third Parties<\/h2>\n<p class=\"p1\"><strong>8.1<\/strong> Except where required by law, confidential information may only be disclosed to a third party with the written, explicit, free, and informed consent of the individual concerned. Such consent may only be given for a specific purpose and for the duration necessary to fulfill it.<\/p>\n<p class=\"p1\"><strong>8.2<\/strong> Given that the Service d&#8217;aide aux conjoints \u2013 SAC works with men who perpetrate domestic violence and is a member of the Crisis Unit of the Montreal Domestic Violence Roundtable, confidential information may be disclosed without consent if the life, health, or safety of the individual or those close to them is seriously threatened.<\/p>\n<p class=\"p1\"><strong>8.3<\/strong> As permitted by law, the Service d&#8217;aide aux conjoints \u2013 SAC may disclose confidential information necessary for its defense or that of its employees against any claim or legal action brought by or on behalf of a Participant, Employee, or their heirs, executors, beneficiaries, or assignees, including claims from their insurers.<\/p>\n\n<h2 id=\"section_9\">9. Communication of Confidential Information to the Individual Concerned<\/h2>\n<p class=\"p1\"><strong>9.1<\/strong> Subject to section 9.2, Participants, Employees, and Board Members have the right to know what confidential information the organization holds about them, to access that information, and to request corrections.<\/p>\n<p class=\"p1\"><strong>9.2<\/strong> Access must be restricted when required by law or when disclosure would likely reveal confidential information about a third party.<\/p>\n<p class=\"p1\"><strong>9.3<\/strong> Requests made under section 9.1 must be addressed within 30 days.<\/p>\n\n<h2 id=\"section_10\">10. Breach of Confidentiality Obligations<\/h2>\n<p class=\"p1\"><strong>10.1<\/strong> An Employee breaches their confidentiality obligations when they: share confidential information with unauthorized individuals; discuss confidential information in settings where unauthorized individuals may overhear; leave confidential information visible in paper or digital form where unauthorized individuals may see it; or fail to follow the provisions of this policy.<\/p>\n<p class=\"p1\"><strong>10.2<\/strong> In the event of a breach, appropriate disciplinary measures will be taken against the offending party, and corrective measures will be implemented to prevent recurrence.<\/p>\n\n<h2 id=\"section_11\">11. Recourse<\/h2>\n<p class=\"p1\"><strong>11.1<\/strong> If an individual&#8217;s confidential information has been used in a manner contrary to this policy, they may file a complaint with the Executive Director of the Service d&#8217;aide aux conjoints \u2013 SAC, or with the Board of Directors if the complaint concerns the Executive Director.<\/p>\n<p class=\"p1\"><strong>11.2<\/strong> As provided by law, an individual who has been denied access to or correction of their personal information may file a complaint with the Commission d&#8217;acc\u00e8s \u00e0 l&#8217;information within 30 days of the organization&#8217;s refusal or the expiration of the response deadline.<\/p>\n<p class=\"p1\"><strong>Adopted by the Board of Directors of the Service d&#8217;aide aux conjoints \u2013 SAC on January 25, 2024<\/strong><\/p>\n\n<h2 id=\"section_a\">Appendix A\nPrivacy Incident: Response Plan<\/h2>\n<p class=\"p1\">When a Participant, Employee, or Board Member becomes aware of a privacy incident, they notify the responsible person using the designated reporting form. The responsible person identifies reasonable measures to reduce the risk of harm and prevent future incidents, then assesses whether a serious risk of harm exists. If so, they promptly notify the Commission d&#8217;acc\u00e8s \u00e0 l&#8217;information (CAI) and any affected individuals using the appropriate form. The responsible person maintains a registry of all incidents and provides a copy to the CAI upon request.<\/p>\n\n<h2 id=\"section_b\">Appendix B\nPrivacy Incident: Communication to Affected Individuals<\/h2>\n<p class=\"p1\">As stated in section 5.5, the organization must notify affected individuals promptly. The written notice must include: a description of the personal information affected (or reasons why it cannot be described); a brief description of the circumstances; the date or approximate period of the incident; a brief description of measures taken or planned to reduce the risk of harm; recommended steps for the affected individual to reduce their own risk; and the contact information of the person who can provide further details.<\/p>\n<h2 id=\"section_c\">Appendix C\nPrivacy Incident: Assessment Questionnaire for &#8220;Serious Risk of Significant Harm&#8221;<\/h2>\n<p class=\"p1\">To assess whether an incident presents a serious risk of harm, the organization must consider the sensitivity of the information involved, the anticipated consequences of its use, and the likelihood it will be used harmfully.<\/p>\n\n<h3>Sensitive information includes:<\/h3>\n<p class=\"p1\">Financial documents and clinical files. Information commonly shared publicly (name, address) is generally not considered sensitive unless the context makes it so.<sup><a href=\"#note_1\" style=\"font-size: 75%\u00a0!important;\">1<\/a><\/sup>\n<\/p>\n\n<h3>Serious harm includes:<\/h3>\n<p class=\"p1\">reputational or relational damage; humiliation; loss of employment or business opportunities; financial loss; identity theft; negative impact on credit; and damage to or loss of property.<\/p>\n<h3>To assess the likelihood of misuse, consider: <\/h3>\n<p class=\"p1\">what happened and the probability of harm; who accessed or could have accessed the information; how long it was exposed; whether misuse has been confirmed; whether malicious intent is evident (theft, hacking); and whether the information was exposed to entities likely to use it harmfully.<\/p>\n<p class=\"p1\">If the analysis reveals a serious risk of harm, the organization must notify the Commission and the affected individuals. Otherwise, it must still take steps to reduce risks and prevent similar incidents from occurring again.\n<\/p>\n\n\n<hr \/>\n<p id=\"note_1\" class=\"p1 note\">1.
